He explained that the court should only proceed if the Magistrate found the action frivolous and vexatious.Prosecutor Datadin at that point interjected and told the Magistrate that he does not see why the case of witness tampering which is before her should be halted as a result of the motion which is engaging the attention of the high court.The prosecutor stated that there is no order from the high court or any other court to prevent the hearing of the witness tampering case.He further added, that if the accused felt that his rights of a fair trial is being violated then he should make his intension known at the first instance of the case hearing which is the layout procedure of the court.Datadin explained that there is no evidence before the Magistrate to prove that the defendant’s rights are being breached.The six accused were all charged with obstruction of justice on April 23 last.That charge arose from the previous allegation of carnal knowledge of a girl under 12 which he was facing.
